FESTIVAL OF FLAVOUR | TERMS & CONDITIONS
These terms and conditions (“terms”) apply to the promotion available on www.vapo.co.nz and www.vapoaustralia.com.au (“VAPO websites”) and VAPO retail stores (“promotion”) by VEC LIMITED, of PO Box 14086, Panmure, Auckland 1741, New Zealand (“we”, “us” or “our”).
By entering the promotion you agree to be bound by and to abide by these terms.
- The Promotion - ‘Festival of Flavour Scratch and WIN’
- Offers: The discounts, rewards, goods or services (“offers”) for the promotion shall be provided to you subject to the terms.
- Eligibility : The promotion is open to anyone who, at the time of entry:
- Completes an order through a VAPO website or VAPO retail store; and
- Is over 18 years of age; and
- Is a current smoker or vaper; and
- Resides in New Zealand or Australia; and
- Is not our employee or an employee of any other agency or business associated with the promotion.
1. Entry
- Entry is open to any customer who places an order, or makes a purchase over $25.00 on a VAPO website or at a VAPO retail store between 12:01am NZST 1 February 2023 and 11:59 pm NZST 5 March 2023.
- All orders placed in accordance with clause 1.3(a) will be eligible to receive 1 x VAPO ‘Scratch and WIN’ card per order.
- A code contained in a Scratch and WIN card can only be redeemed once - either online at a VAPO website or at a VAPO retail store.
- A Scratch and WIN card discount used at a VAPO Website or VAPO retail store will not be eligible to receive a new scratch card from that purchase or loyalty points on www.vapoaustralia.com.au. All customers must place or make another order over $25.00 that does not include a discount from a Scratch and WIN card to receive another card.
- Entry is open to any customer who places an order, or makes a purchase over $25.00 on a VAPO website or at a VAPO retail store between 12:01am NZST 1 February 2023 and 11:59 pm NZST 5 March 2023.

2. Prizes
- Each VAPO Scratch and WIN card will contain either a discount ranging from 10% - 30%, free product, music vouchers or UE Booms. These discounts and free products can only be redeemed off the next order at VAPO and cannot be utilised on the order that provided the recipient with the card. Cards are randomly selected prior to being distributed to customers participating in the promotion.
- All codes related to this promotion will be valid between 12:01am NZST 1 February 2023 and 11:59 pm NZST 31st March 2023.
- All discounts will be limited to a $500 maximum spend limit online or in store before the discount is applied and cannot be combined with or used in conjunction with any other discounts or redeemed for cash or store credit.
- 5 (NZ) and 3 (AU) x Scratch and WIN cards will contain a UE Boom Prize (RRP $150).
- All codes related to this promotion will be valid between 12:01am NZST 1 February 2023 and 11:59 pm NZST 31st March 2023.

- Australian based customers may only redeem their discount at www.vapoaustralia.com.au.
- All recipients of Spotify gift cards and UE Boom Prize scratch card must contact us directly at marketing@vapo.co.nz and must provide and verify their personal information before the prize will be issued.
- Scratch and WIN card scan only be redeemed on a VAPO website or in a VAPO retail store. Not at any other third party supplier.
- Australian based customers may only redeem their discount at www.vapoaustralia.com.au.
- All recipients of Spotify gift cards and UE Boom Prize scratch card must contact us directly at marketing@vapo.co.nz and must provide and verify their personal information before the prize will be issued.
3. Terms and Conditions
- You must enter a unique code when redeeming the discount on your card on a VAPO website or at a VAPO retail store. All discount codes are unique codes and can only be used once per customer.
- The promotion may require you to undertake further actions not described in these terms, for example choosing any goods or services made available as a part of the offer.
- The promotion is subject to available inventory and stock, including a limited allocation for the promotion. Certain stock or inventory may not be made available for the promotion and all free products is only while stocks last.
- As a condition of the promotion, you must provide your contact information and agree to opt-in to receive marketing emails, subject to the terms of Our Privacy Policy.
- Except as expressly stated herein, this promotion may not be used in conjunction with any other offer or promotion currently made available by us.
- If requested by us, you must provide a valid identity document issued by a competent authority providing age verification in accordance with our age verification policies and procedures and subject to the terms of Our Privacy Policy (“Age Verification”). If you fail to complete the Age Verification you will not be able to participate in the Promotion or receive any offers.
- We reserve the right to decline the offer to any person in our sole discretion without incurring any liability to you.
- This promotion is only available to members of the public and not for use by trade or retailers. If we believe you are a retailer participating in the promotion. your order will be cancelled.
4. Miscellaneous
- All personal data shared by you with us in relation to this promotion are held by us subject to the terms of Our Privacy Policy made available at https://www.vapo.co.nz/pages/privacy-policy or https://www.vapoaustralia.com.au/privacy-policy. By participating in the promotion you agree to the terms of Our Privacy Policy.
- No refunds, returns or exchanges will be provided by us except as required by applicable law.
- With the exception of liability which cannot be limited or excluded by applicable law, we exclude and limit all liability, including for death, personal injury, loss or damage (including loss of opportunity and whether direct, indirect, special or consequential) suffered or incurred by any person (whether or not arising from any person's negligence) arising in any way out of or in connection with the Promotion or the Offer including, without limitation, liability for theft, mail delivery failure, unauthorised access or third party interference, any technical difficulties or equipment malfunction (whether or not under our control), any tax liability incurred by you including self-assessed tax liabilities.
- You indemnify and will keep us indemnified against all loss and damage whatsoever suffered (including but not limited to indirect or consequential loss) by us arising out of any breach of these terms by you.
- Electronic cigarettes may be hazardous to health and contain nicotine which is addictive. Electronic cigarettes are not suitable for use by persons under the age of 18, persons who are allergic/sensitive to nicotine, pregnant or breast-feeding women, persons who should avoid using tobacco or nicotine products for medical reasons, or persons with an unstable heart condition, severe hypertension or diabetes.

These terms, and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the laws of New Zealand.
Each party irrevocably agrees that the courts of Auckland, New Zealand, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Promotion and the Terms.
We reserve the right to change, amend, withdraw or cancel this promotion or these terms at any time without notice and in our absolute and sole discretion.
