BLACK FRIDAY | TERMS AND CONDITIONS 2023

 

We, VEC LIMITED, of PO Box 14086, Panmure, Auckland 1741, New Zealand (“VAPO”, “VEC LIMITED” “We”, “Us” or “Ours”) make available to VAPO customers (“You”, “Your” or “Customer(s)”) the promotion available on the VAPO websites (www.vapo.co.nz & www.vapoaustralia.com.au) and various partner and social media sites (“Promotion”), subject to the terms and conditions contained herein (“Terms”).

By proceeding with and taking advantage of the Promotion and engaging further with Us, You agree to be bound by and to abide by these Terms.

1. Promotion

This promotion runs from Wednesday the 22nd of November until Sunday 26th of November 2023.

Customers will receive;

50% off selected Caliburn devices (offer excludes Caliburn G3)
50% off selected pods*
25% off Rift devices and replacement pods

The following specific discount, reward, goods or services (“Offer”) shall be provided on the following conditions as our Promotion to Customers and subject to these Terms:

This promotion runs from Wednesday 22nd November until Sunday 26th November 2023 and is available online exclusively at vapoaustralia.com.au for that period.

2. Terms and Conditions

To receive the Offer and to participate in the Promotion, the Customer agrees as follows:

1. The Promotion runs from 22/11/23 until 26/11/23 online at vapoaustralia.com.au
2. All discounts outlined will be automatically applied. 
3. The Promotion is subject to available inventory and stock, including a limited allocation for the Promotion. Certain stock or inventory may not be made available for the Promotion.
4. This Promotion may not be used in conjunction with any other offer or promotion currently made available by VAPO. 
5. The Promotion is only available to members of the general public and is not intended for trade or retailers. Transactions may be voided if we believe a trader/retailer is taking advantage of this consumer promotion.
6. The Promotion is available only at official vapoaustralia.com.au
7. The customer confirms they are a resident of Australia and currently in Australia at the time of any engagement in the Promotion
8. The customer confirms they are 18 years or over and a current smoker or vaper. Customer confirms they have a valid identity document issued by a competent authority providing age verification, and that they will provide this to Us in accordance with our age verification policies and procedures and subject to the terms of Our Privacy Policy (“Age Verification”).
9. Customer understands and agrees that if they fail to complete the Age Verification they will not be able to participate in the Promotion nor receive the Offer. Any Promotion of Offer is void where prohibited by applicable law or where the Customer is under 18.
10. The customer confirms that they have a current and valid prescription for purchasing and using vaping devices, for the sole purpose of quitting smoking cigarettes.
11. We reserve the right to scrutinise all Customer details, intentions and behaviours and decline the Offer to any prospective customer or person in our sole discretion and without limitation.
    
    

All personal data shared by You with Us about this Promotion are held by Us subject to the terms of Our Privacy Policy made available at https://www.vapoaustralia.co.au/pages/privacy-policy. By participating in the Promotion you agree to the terms of Our Privacy Policy.

No refunds, returns or exchanges will be entertained except as applicable law requires.

Except liability which cannot be limited or excluded by applicable law, We (including Our Affiliates, related companies and their and Our respective officers, agents and employees) exclude and limit all applicable liability, including for death, personal injury, loss or damage (including loss of opportunity and whether direct, indirect, special or consequential) suffered or incurred by any person (whether or not arising from any person's negligence) arising in any way out of or in connection with the Promotion or the Offer. Without limiting those above this shall include a) theft, mail delivery failure, unauthorised access or third-party interference; b) any technical difficulties or equipment malfunction (whether or not under Our control); c) any tax liability incurred by You including self-assessed tax liabilities; d) Your participation in or use of the Offer.

Customer indemnifies and will keep indemnified alt. against all loss and damage whatsoever suffered (including but not limited to indirect or consequential loss) by alt. arising out of any failure of the Customer to adhere to these Terms.

VEC LIMITED electronic cigarettes may be hazardous to health and contain nicotine which is addictive. VEC LIMITED electronic cigarettes are not suitable for use by: persons under the age of 18; persons who are allergic/sensitive to nicotine; pregnant or breast-feeding women; persons who should avoid using tobacco or nicotine products for medical reasons; or persons with an unstable heart condition, severe hypertension or diabetes. Keep VEC LIMITED products out of reach of children. 

These Terms and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the laws of New Zealand.

Each party irrevocably agrees that the courts of Auckland, New Zealand, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Promotion and the Terms.

We reserve the right to change, amend, withdraw or cancel this Promotion or these Terms at any time without notice and in our absolute and sole discretion.
